AI Briefing: How Google and DOJ’s latest antitrust arguments address AI

Lawyers for the Department of Justice and Google filed lengthy written arguments Nov. 4 in the ad-tech antitrust trial ahead of closing arguments later this month. Totaling more than 1,000 pages, the revised findings of fact (FOF) threaded together court evidence and witness testimony along with each party’s argument for the case through a legal lens. One aspect is the role of AI in arguments from both parties, which has consistently evolved.

Recent innovations like large language models aren’t the focus of ongoing search and ad-tech trials between the DOJ and Google. However, experts have said court rulings in both cases could affect Google’s ability to amass data for generative AI like it’s done in the past. The latest filings also offer an updated look at both sides’ arguments and how they’ve evolved in the weeks since the trial began in September — with AI as just one narrow angle of viewing the lengthy legal text.

Even without mentioning newer areas of AI like LLMs or AI-generated content, both sides do talk about other major online platforms invested in AI like TikTok, Reddit and Meta. AI arguments in the revised versions also don’t drastically affect either’s arguments, said Sarah Oh Lam, senior fellow at Technology Policy Institute.

As programmatic rises on Roblox, in-game studios are feeling the competition

After years of focusing their Roblox spending on bespoke brand activations, marketers are keying into the programmatic advertising opportunity on the platform. Roblox studios view this trend as a rising tide that will lift all ships — but as brands explore alternatives to immersive integrations, studios anticipate potential competition between their services and Roblox’s programmatic offering.

In recent years, brands have paid Roblox studios hundreds of thousands of dollars to develop and build branded games such as “Barbie DreamHouse Tycoon” and “Walmart Discovered.” These custom-branded Roblox worlds have long been considered the default method for brands to reach users inside Roblox, and an ecosystem of developer studios has arisen to meet the demand, with some studios becoming official Roblox partners last year. 

But while Roblox has welcomed developers to set up shop on the platform, the marketing dollars that brands spent on immersive integrations largely went to studios rather than to the platform itself. Roblox’s programmatic video ad business, which launched in May of this year, represents a much more direct advertising revenue stream for the company, so it’s no surprise that Roblox has encouraged marketers to explore the opportunity over the past year through a series of strategic partnerships and agency roadshows.

This year’s race for the White House has been a tumultuous one for many reasons. In July, after calls to exit the 2024 race, President Joe Biden officially dropped out and endorsed VP Harris. And with barely 100 days to campaign for office, VP Harris was met with optimism and doubt. Throughout the Democrats’ presidential campaign struggles, Republican nominee Trump faced his own setbacks, including claims of racism and anti-immigration rhetoric, among other allegations.
